How to rotate an empty selection in photoshop?

I'm actually an advanced user, so this is completely ridiculous to me. I've been retouching this cyborg for hours and at least a couple times i've wanted to rotate or scale a selection without actually affecting any of the layers. Unfortunately every time i try to on an empty layer, photoshop says it can't because no pixels are selected and every time i try without any layer selected, it says no layers are selected. I recently updated to CS6 and i don't remember ever having this issue before.

i don't thik you can rotate rotation in blank layer, at least a dot in the selection must exist.
