The Lion page at Apple, linked below, sounds more a convenience and given the number of new Mac people asking about downloading 10.7 OS, I strongly think the OS will also be available through disk purchase. Per the information 10.5.8 will need to be upgraded to 10.6 first.
Before rushing out and buying it though I would recommend 1) check the link and be certain your system meets requirements. Also you may want to consider waiting a bit as some developers may need to design drivers or updates for apps.
I too have an iMac running 10.5.8, have 10.6 here and have not upgraded. Now I am considering it. Though recognized I will loose some games, the sync of a PDA and have concerns about multiple drivers for printers and scanners. My approach is going to be to all drivers and app software updates in hand BEFORE upgrading. I will burn those to disk and have ready for the upgrade, along with my Time Machine backup. I'm really interested in seeing how Time Machine will be used to restore my data. Just keep in mind that there is a bit change with a 10.6 upgrade and we really don't know yet what is under the hood of 10.7

Sorry to tell you, but I will be too busy to check back later to see if your question changes again. The answer to your latest edition of the question is "Yes, you will be allowed to buy it from a shop, including any Apple retail store."
About the part "considering i have Mac 10.5", I have no insight into the installer requirements yet, but I would bet it will not install over OS 10.5.x. Either you upgrade to 10.6 and then to 10.7, or you have to choose another method, such as a separate partition or an Erase & Install. This is the same dilema faced by owners of first generation Intel Macs running OS 10.4.x who bought OS 10.6 install DVDs. The installer would not go forward with a simple installation over OS 10.4.x.
